Democrat Harvard Law Prof Predicts a SCOTUS Trump Victory

Attor­ney Alan Der­showitz, the out­spo­ken Demo­c­rat who defend­ed Pres­i­dent Trump dur­ing the Sen­ate impeach­ment tri­al, pre­dicts that the pres­i­dent will pre­vail in his Penn­syl­va­nia lawsuit.

Speak­ing with “Bre­it­bart News Tonight,” Der­showitz said that the U.S. Supreme Court will like­ly take up the president’s law­suit against Penn­syl­va­nia due to the fact that the state’s court imple­ment­ed elec­tion laws that the state leg­is­la­ture did not approve.

“I do think that Trump will win the Penn­syl­va­nia law­suit … name­ly, the law­suit that chal­lenges bal­lots that were filed before the end of Elec­tion Day, but not received until after Elec­tion Day,” Der­showitz said.

“The [Penn­syl­va­nia] leg­is­la­ture had basi­cal­ly said no to that, and the state Supreme Court said yes because of the pan­dem­ic,” he con­tin­ued. “That may have been the right deci­sion in some the­o­ret­i­cal sense, but the Con­sti­tu­tion doesn’t per­mit any­body in the state but the leg­is­la­ture to make deci­sions about elections.”

Cit­ing the Bush v. Gore case in 2000, Der­showitz assert­ed that Pres­i­dent Trump may very well over­turn the Penn­syl­va­nia elec­tion call if he and his legal team can prove that the seg­re­gat­ed bal­lots helped sway the election.
